Welcome to S. Theresa Carlsens’ Photo Memories. By booking a photography session or using this website, you agree to the following Terms and Conditions. Please read them carefully before proceeding with any service or purchase.
These Terms and Conditions (“Terms”) govern all photography sessions, digital products, and related services provided by S. Theresa Carlsens’ Photo Memories (“the Photographer,” “we,” “us,” or “our”). By engaging our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
All bookings are confirmed only upon receipt of a deposit or full payment, as specified during the booking process. Session dates and times are reserved exclusively for the client once payment is received. The remaining balance, if applicable, must be paid by the date of the session unless otherwise stated.
Failure to make timely payment may result in cancellation or postponement of the session. Prices are subject to change without prior notice, though confirmed bookings will be honored at the agreed rate.
Clients who wish to cancel or reschedule must provide written notice at least seven (7) days prior to the scheduled session. Deposits are non-refundable, but may be applied toward a future session at our discretion.
In the event of unforeseen circumstances such as illness, extreme weather, or equipment failure, S. Theresa Carlsens’ Photo Memories reserves the right to reschedule the session. Should a reschedule not be possible, a full refund will be issued.
All images created by S. Theresa Carlsens’ Photo Memories are protected under U.S. Copyright Law. The Photographer retains full copyright and ownership of all images unless otherwise agreed upon in writing.
Clients are granted personal usage rights to print, share, and display the images for non-commercial purposes. Commercial use, reproduction, sale, or publication of any image without prior written consent is strictly prohibited.
The Photographer reserves the right to use selected images for promotional purposes, including but not limited to the website, social media, advertising, and portfolio display. Clients who wish to opt out must notify us in writing before the session.
All images provided will be professionally edited in the Photographer’s signature style. Basic retouching (color correction, exposure, and composition adjustments) is included in all sessions.
Delivery of final images will typically occur within 2–4 weeks following the session, unless otherwise stated. Raw, unedited files are not included or available for purchase unless explicitly agreed upon in writing.
Clients are responsible for arriving on time and being prepared for their session. Sessions that begin late due to client delay may result in a shortened session without adjustment to the agreed fee.
Children or pets photographed must be supervised by an adult at all times. The Photographer is not responsible for accidents, damages, or injuries occurring during the session.
In the unlikely event of loss, damage, or total photographic failure, the Photographer’s liability is limited to the return of all payments received for the affected session. S. Theresa Carlsens’ Photo Memories shall not be held liable for indirect or consequential loss.
All personal information provided to S. Theresa Carlsens’ Photo Memories is treated as confidential and used solely for business and communication purposes. Client information will never be sold or shared with third parties without consent.
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the United States of America. Any disputes arising shall be subject to the exclusive jurisdiction of the appropriate state and federal courts.
